SRINAGAR: Jammu and Kashmir High Court has quashed detention orders under Public Safety Act against three detainees and ordered their release from custody.

According to different orders passed the Justice Ali Mohammad Magrey, Justice Tashi Rabstan and Justice Rajnesh Oswal, the PSA detention orders have been quashed against Waheed Ahmad Gojri son of Abdul Ahad Gojri of Rawalpora Tehsil Kralgund, Zahoor Abbas Khan and Uzair Maqbool Malik of Shopian.

Waheed had been detained under detention order (no. 10-DMK/PSA of 2020) on 8 October 2020 by District Magistrate, Kupwara while Khan and Malik were detained under order (No. DMS/PSA/2020/217) and (no.47/DMS/PSA/2019) by deputy commission Shopian on 11 July 2020 and 16 August 2019 respectively.

While quashing Waheed’s detention order, Justice Ali Mohammad Magrey said that the detainee was not supplied the materials relied upon by the detaining authority.

“The (detainee) was provided material in the shape of grounds of detention with no other material /documents, as referred to in the order of detention. On these counts alone, the detention of the (detainee) is vitiated,” the court said in the order, a copy of which lies with news agency GNS and subsequently directed that Waheed be released from preventive custody forthwith.

Similarly Justice Tashi Rabstan quashed the order (no.47/DMS/PSA/2019 dated 16.08.2019), passed by District Magistrate, Shopian and directed officials including Jail Superintendent concerned to release Malik forthwith, provided he is not required in any other case

Justice Rajnesh Oswal ordered that Zahoor Abbas Khan be set free from the preventive custody, provided he is not required in any other case
