The action has reportedly been initiated under provisions of the Immigration and Foreigners Act, 2025, as Khan holds US citizenship and is not an Indian national. Police action followed his participation in a demonstration at Mumbai’s August Kranti Maidan on October 10, media reports said.

The protest, held in support of the Cockroach Janata Party (CJP), demanded Gyanesh Kumar’s resignation over allegations concerning the revision of electoral rolls. Khan was among hundreds of people detained by Mumbai Police during the demonstration, which authorities said had not been authorised at the venue.

BJP leader Kirit Somaiya had questioned the actor’s participation in the protest and urged the police to take action, alleging violations of immigration rules and conditions governing Khan’s Overseas Citizen of India (OCI) status.

Khan, who was reportedly accompanied by his girlfriend, Lekha Washington, and his niece, has not been quoted in the reports provided as responding to the notice.

OCI status allows eligible foreign nationals of Indian origin to reside in India and access specified privileges, but it does not confer Indian citizenship.
