SRINAGAR: The Jammu and Kashmir Government has formally accepted the resignation of Dr Nigha Nazir, a Medical Officer in the Health and Family Welfare (Gazetted) Service, with retrospective effect from November 28, 2022, while rejecting her request to rejoin government service.
The decision was issued by the Health and Medical Education (H and ME) Department through Government Order No. 582-JK(HME) of 2026, dated July 24, 2026, in exercise of powers under Article 200 of the Jammu and Kashmir Civil Service Regulations, Volume I.
According to the order, the Directorate of Health Services, Kashmir had forwarded Dr Nazir’s application on April 23, 2026, seeking permission to resume government service. In her representation, she stated that she had resigned due to compelling personal circumstances, including her father’s medical condition, and requested sympathetic consideration for her rejoining.
Dr Nazir was appointed as a Medical Officer through Government Order No. 487-HME of 2019 dated May 17, 2019, and was posted at Health Centre Balahama in Rafiabad, Baramulla. She had tendered her resignation with effect from November 28, 2022.
The government order states that departmental records showed Dr Nazir had been selected for a postgraduate medical course through the Jammu and Kashmir Board of Professional Entrance Examinations (JKBOPEE) in 2022 and had also sought study leave. However, as she had not completed the mandatory five years of service, she was not eligible for study leave under the applicable rules.
The department observed that the sequence of events indicated that the doctor appeared to have pursued, and possibly completed, the postgraduate course without obtaining prior permission from the competent authority. It further stated that the omission of this information in her representation raised serious concerns over suppression of facts and lack of transparency.
Rejecting her request to rejoin service, the government said the doctor had voluntarily resigned and remained away from service, making her request untenable. It also held that she had violated the terms and conditions of her appointment and departmental guidelines governing study leave and service obligations, adversely affecting healthcare services at Health Centre Balahama for nearly three years.
The order further states that her conduct amounted to serious dereliction of duty and grave negligence, besides violating the policy issued under Government Order No. 905-HME of 2019 dated October 17, 2019, read with Circular No. 18-HME of 2020 dated December 29, 2020.
Consequently, the government accepted her resignation with effect from November 28, 2022, and ordered that her lien in the Jammu and Kashmir Health and Family Welfare (Gazetted) Service shall be deemed to have been terminated.
