A Division Bench of the Jammu and Kashmir High Court has directed Commissioner/Secretary Housing and Urban Development Department to immediately shift Ram Pal Sharma, Secretary J&K Housing Board and Aftab Ahmed Pandit, DGM Unit-II J&K Housing Board in view of the pendency of a regular departmental enquiry into Rs 27 crore scam in J&K Housing Board.

The directions have been passed in a Public Interest Litigation titled Sheikh Mohammd Shafi & Anr V/s Union of India & Ors.

Advocate Sheikh Shakeel Ahmed appearing for the PIL submitted that State Government has appointed Commissioner, Jammu Municipal Corporation as Inquiry Officer to hold Regular Departmental Enquiry against Ram Pal Sharma and Aftab Ahmed Pandit and on 18-08-2017 the Commissioner/Secretary extended two months time for finalization of the enquiry. Not only this the draft chargesheets have also been forwarded to the Commissioner/Secretary PWD to proceed against the four Executive Engineers who were on deputation in J&K Housing Board.

The Division Bench also directed Director General Accounts and Treasuries J&K Government to also file the status of the on-going enquiry against Kulbushan Kumar the then Financial Advisor/Chief Accounts Officer J&K Housing Board within four weeks. The Division Bench also directed several Commissioner/ Secretaries to file the latest status of 147 departmental enquiries.

Matter has been directed to be posted immediately after four weeks.
