A trial court in south Kashmir’s Awantipora has sentenced a man to three years’ rigorous imprisonment for sodomizing a minor boy.

The Court of Additional Special Mobile Magistrate Awantipora convicted Javid Ahmad Dar, son of Abdul Gani Dar, a resident of Aghanjipora, for sodomising a four-year-old boy.

A police spokesperson in a statement said that the convict after employing deceitful means had taken the minor boy on bicycle away from his home and committed the gruesome and heinous offence of sodomy.

“He has been sentenced to undergo rigorous imprisonment for a period of three years for the commission of offence punishable U/S 377 RPC   and a fine of rupees five thousand (5000/=)  has also been imposed   upon him for the commission of said offence and in case of  default in payment of fine, trial court has ordered  that he shall undergo   imprisonment for one more year,” said police spokesman.

“The trial court turned down the plea of the convict for release on probation in terms of section 562 Cr P.C after Khursheed Ahmad Senior Prosecuting Officer who represented the state in the case vehemently resisted the same,” he said.

“The trial court while concluding the judgment observed that the commission of offence under section 377 RPC by the convict against the victim must have created a trauma to the victim who was at that time 3-4 years old and said act on the part of convict is very brutal and is to be condemned strongly,” said the spokesman.

“It has also been observed by the trial court that it is very painful even to imagine what kind of agony or trauma a 3 or 4 year child must have gone through while being subjected to such a brutal act of sodomy,” he said.

“The conviction of accused will serve twin objectives of administration of justice as well as sending a signal to such members of society who are subjecting children and members of the weaker sections of the society to such kind of brutal acts,” the spokesman said.
