The Budgam court on Monday stayed the impugned judgment over Khyber Agro Pvt ltd wherein the company was fined over its alleged reports of adulteration.

Earlier, court had found Khyber Agro Farms Pvt ltd guilty of selling unsafe milk to people in Valley and has imposed a fine Rs 9 lakh besides awarding six months imprisonment to its nominated person, Mohammad Shafi Ganie of Ganderbal.

The court of judicial magistrate Budgam Imtiaz Ahmad Lone passed the judgment on a complaint filed by food safety officer Zeenat Ayoub.

The FSO had filed the complaint following inspection tour to main market Budgam where in a number of Food Business Establishments (FBE) including the FBE of Ghulam Ali Khan proprietor M/S Yaseen Provisional Store were inspected.

The FSO had obtained samples of Khyber tonned milk under section 38 and 47 of FSS, act 2006. After examining the food articles, the FSO had physically served a notice to the accused persons.

Meanwhile, court today stayed the operation of impugned judgment into Khyber Agro while the order of conviction and sentence is suspended pending disposal of the main appeal.

The court documents in possession of KNS reveals, “The food stuffs including the milk sold by pity manufacturers, retailers, hawkers, itinerant vendors, temporary stall holders have appeared to be major threat to the public health, as the said persons escape the surveillance by the authorities under the Act. It is expected that the commissioner of Food Safety and his subordinate competent officers may devote their attention.”
