Police Thursday morning shifted separatist leader Nayeem Ahmad Khan to Kotbalwal jail Jammu under Public Safety Act (PSA) 1978 alleging him for “promoting terrorism”. National Front chairman, Khan was languishing in central jail Srinagar since his arrest on February 8, 2013. Khan has been booked under PSA orders issued in 2011.

In its order No DMS/PSA/38/2011, dated September 30, 2011, district magistrate Srinagar has said to Khan, “You are known for promoting terrorism through exploitation of gullible youth who you incite to resort to violence.” Khan was recently re-arrested after a Court dismissed charges against him under FIR No 5/2000.

In the fresh charges against Khan he has been alleged of being in close contact with “local and foreign elements that are inimical to India”. The charges against him read, “….you assumed a high position in secessionist circles and you are reported to be in close contact with the elements inimical to India. Such elements include both the locals as well as foreigners”.

Khan has been charged of launching “a vicious media campaign against the union of India by maintaining a continuous presence in various forms of media”. District magistrate Srinagar has mentioned his various statements appeared in the local dailies from time to time.

The district magistrate while issuing PSA orders against Khan has said, “Your activities are highly prejudicial to the maintenance of security of state……. In order to stop you from indulging in such activities……your detention under the provisions of PSA at this stage has become imperative”.

While shifting Khan to Kotbalwal jail Jammu, district magistrate has said, “…..after verifying the present status of lodgement capacity of central jail Srinagar, which is overcrowded, I am constrained to direct the lodgement of the detenue at Kotbalwal Jail Jammu”.

While issuing PSA orders against Khan, district magistrate Srinagar has referred to the letter from SSP Srinagar, under No Lgl/Det-2750/2011/5243-46 dated September 24, 2011. The magistrate has said, “SSP Srinagar has produced material record, such as dossier and other connecting documents in respect of Nayeem Ahmad Khan”.

A National spokesman told Kashmir Life that Khan was yesterday evening shifted from central jail Srinagar, to police station Karan Nagar where from a police party on Thursday morning proceeded to Kotbalwal jail Jammu.
