Jammu Kashmir High Court Thursday issued notices to different heads of the government departments directing them to clear their position with regard to conversion of Agriculture land illegally into commercial one.
Former legislative council member Murtaza Khan had filed a petition in Jammu High Court submitting that a Rajasthan based construction company ‘Adarsh Builders Limited’ under the banner of ‘Palm Riviera’ has been constructing 262 flats in Jammu and Kashmir.
The petitioner had alleged that the said company in violation of the law has constructed these flats on agricultural land in Sidra Jammu and the facts despite known to the higher officials; no action was initiated against the said company.
The sole purpose of the company according to petitioner is to sell these flats to desired people to extract maximum profits. The petitioner had submitted that the company used agricultural land for the construction purpose and all the flats under construction in Sidra Jammu are glaring example.
Justice Tashi Rabistan after hearing the petitioner directed the government to clear its stand.
The court issued notices to Commissioner Secretary Revenue, Commissioner Secretary Agriculture, Commissioner Housing and Urban Development Department, Commissioner Jammu Municipal Corporation, Senior Town Planner Jammu, Deputy Commissioner Jammu, Chief Agricultural Office Jammu, Station House Officer Jammu, Managing Director Palm Riviera and others.
The court directed them to clear their positions on the next date of hearing while maintaining that till next date of hearing, status quo, as on today, with respect to the present position of the property in question shall be maintained. (CNS)
