High Court on Wednesday quashed the detention of Mohammad Shaban Dar son of Abdul Gani Dar. Dar, a resident of Wanpora, Kulgam is district president Tehreek-e-Hurriyat for Kulgam. Dar was arrested last year and detained under Public Safety Act PSA.  The decision in this effect was taken by Justice Muzaffar Attar.

The detention under PSA of Abdul Rashid Wagay s/o Gh Hassan Wagay was also quashed. Wagay, a resident of Arigoton kulgam was also arrested last year.

The court of Justice Mohammad Yaqoob Mir also quashed the detention of Sabzar Ahmad Bhat s/o Ghulam Mohammad Bhat. A resident of Kulgam, Bhat, is facing detention under PSA from last 8 years. Bhat is presently lodged in district jail Kuthua.

The detention of Nazir Ah Mir s/o Mohammad Amin Mir, a resident of Arigoton was also quashed by Justice Mohammad Yaqoob Mir.

Meanwhile, High Court directed the shifting of Tehreek-e-Hurriyat district president, Hafiz ullah Mir s/o Ghulam Mohammad Mir to central Jail Srinagar to enable him to appear in examination. Mir, when arrested was acting as a frontline leader of Tehreek-e-Hurriyat in south Kashmir. Mir, a resident of Budroo, Achabal Islamabad, according to Tehreek-e-Hurriyat sources was arrested in 2008 and after releasing for a brief period he was again arrested and slapped by PSA in 2011. Mir is currently lodged in district jail Hiranagar.

The High Court however, reserved the judgement about the quashment of PSA against Tariq Ahmad Shah, a resident of  Bijbehara, Islamabad. The said prisoners where represented by senior advocate Mian Abdul Qayoom and advocate Mohammad Shafi Reshi, besides advocate Nasir Qadri and advocate Mian Tufail.

Meanwhile, a Tehreek-e-Hurriyat leader on the condition of anonymity told Kashmir Life that the government seldom honours the decisions taken by the courts. “They (government) book prisoners in new fake cases after their old ones are quashed by the courts.”
