Court of Principal District and Sessions Judge Budgam has sentenced one person namely Kamal Jeet Singh @ Rinku son of Aya Sing, a resident of Attina Beerwah of district Budgam for rigorous imprisonment for life for raping and murdering two minor girls of the age of six and three years respectively after kidnapping them in a case filed against him under FIR No 113/2002 under sections 364, 342,376, 302 & 176 RPC in Police Station Beerwah.

The court has held: “For the foregoing discussion, the accused is sentenced to imprisonment of 10 years and fine of Rs. 25000/- for the commission of offence punishable under Section 366 RPC; to the imprisonment of one year and fine of Rs. 1000/- for the commission of offence under section 342 RPC; to the rigorous imprisonment for life and fine of rupees 30000/- for the commission of offence under Section 376 RPC & again to the rigorous imprisonment for life and fine of Rs. 45,000/- for the commission of offence under Section 302 RPC.”

The court in its order further stated: “The sentences of imprisonment awarded for the offences under Sections 366 and 342 RPC shall stand set off against the period already undergone by the accused. The accused shall now suffer the rigorous imprisonment for life concurrently under Sections 376 and 302 RPC and shall also be liable for payment of fine as awarded. Since the imprisonment for life awarded by this court under each of the sections ie 376 and 302 RPC is subject to the confirmation by the Hon’ble High Court in view of Section 374 of the code as such, the proceedings of the case are submitted to the Hon’ble High Court of J&K at Srinagar for confirmation of the sentence of life imprisonment.”

“The convictee shall remain in the central Jail Srinagar subject to the confirmation of the sentence of life imprisonment awarded against him. In a case of confirmation of sentence of life imprisonment by the Hon’ble High Court, the requisite warrant for execution of sentence as mandated under Section 381 of the Code shall follow. Since the convictee has been sentenced to the rigorous imprisonment for life, he can prefer an appeal against the sentence within a period of 14 days before the Hon’ble High Court of Jammu and Kashmir, if he so chooses. A copy of the judgment of conviction dated 10.12.2016 has already been provided free of cost to the convictee.”
