SRINAGAR: In a significant legal step, the Budgam Police has secured the declaration of Dr Ghulam Nabi Fai as a proclaimed offender in a case under the Unlawful Activities (Prevention) Act (UAPA). The declaration was made by the Special Judge of the NIA Court, Budgam, on April 30, 2025.
Dr Fai, a native of Wadwan in Budgam, is currently residing in the United States and is evading arrest in connection with FIR No 46 of 2020 registered at Police Station Budgam. The case involves serious charges under Sections 10, 13, and 39 of the UAPA.
According to police, despite the issuance of warrants, Dr Fai has repeatedly failed to cooperate with investigators and has deliberately avoided arrest. Taking cognisance of his continued evasion, Budgam Police moved a formal plea seeking his declaration as a proclaimed offender. The court, after examining the matter, accepted the plea and ordered that Dr Fai must surrender before the Jammu and Kashmir Police within 30 days from the date of the proclamation.
In a statement, Budgam Police reiterated its resolve to pursue all legal avenues to bring fugitives to justice, regardless of their location. The force affirmed that legal proceedings will continue against individuals attempting to obstruct justice, whether based in India or abroad.
Dr Ghulam Nabi Fai, long known for his diaspora-based activism, now faces intensified legal scrutiny under India’s anti-terror laws, with the proclamation marking a crucial escalation in the case against him. He is an American citizen.
