Jammu Kashmir Govt Orders Fresh Inquiry Against Junior Engineer in ACB Case

   

SRINAGAR: The Jammu and Kashmir Government has ordered a fresh departmental inquiry against former Junior Engineer Arshad Amin in connection with a corruption case registered by the Anti-Corruption Bureau (ACB), Central Jammu, rejecting the findings and recommendations of an earlier inquiry.

The Public Works (R&B) Department issued Government Order No. 343-PW(R&B) of 2026 on September 30, sanctioning regular departmental proceedings against Amin, who was then posted as a Junior Engineer (REW) in the BDO Office, Changa, in Gandoh tehsil of Doda district.

Amin was arrested in connection with FIR No. 06/2021 registered at Police Station ACB (Central), Jammu, under Section 7 of the Prevention of Corruption Act, 1988.

The Department of Rural Development and Panchayati Raj (DRD&PR) subsequently served him a memorandum containing articles of charge and a statement of imputations. His statement of defence was examined but was not found satisfactory, according to the government order.

An inquiry was initiated after the DRD&PR appointed the Assistant Commissioner (Development), Kishtwar, as Inquiry Officer through Government Order No. 36-RD&PR of 2025 dated February 4, 2025. The inquiry report was examined by the department, which found shortcomings and sought clarifications and comments from the Inquiry Officer.

The DRD&PR later forwarded the case records and inquiry report to the Public Works (R&B) Department through a memorandum dated July 21, 2026, recommending imposition of a penalty under Rule 30 of the J&K Civil Service (Classification, Control and Appeal) Rules, 1956, for alleged gross misconduct.

The General Administration Department had earlier sanctioned prosecution against Amin through Government Order No. 30-JK-GAD(Vig) of 2023 dated June 23, 2023, and recommended consideration of the matter under Rule 31 of the J&K Civil Service (CCA) Rules, 1956.

After examining the records received from the DRD&PR and the ACB, the competent disciplinary authority rejected the findings and recommendations of the earlier inquiry and decided to conduct a fresh inquiry under the Public Works (R&B) Department.

The fresh proceedings will adopt the memorandum, articles of charge and statement of imputations already served on Amin by the DRD&PR.

Er. Shivangi Gupta, In-charge Superintending Engineer, PMGSY Batote, has been appointed Inquiry Officer, while Er. Suresh Bharti, In-charge Executive Engineer, RDD Doda, has been appointed Presenting Officer.

The Inquiry Officer has been directed to submit her report along with clear recommendations within one month of the order’s issuance, with the findings confined to the mandate prescribed under Central Vigilance Commission guidelines.
