Khanyar ‘Bogus Voting’ Case: HC stays CJM’s Order

SRINAGAR

Jammu and Kashmir High Court has stayed the order of Chief Judicial Magistrate Srinagar seeking probe to the alleged ‘irregularities’ in election process in Khanyar assembly segment during the recently held polls.

The order was passed by Justice Hassnain Massodi in which he has directed SHO Khanyar to withhold the enquiry if at all it was launched on the directions of the Chief Judicial Magistrate.

“On consideration, I find, serious and important issues including the issue of touching of learned Magistrate to pass the impugned order raised in the petition. The matter, therefore, calls for consideration and till such consideration are accorded, for keeping impugned order in abeyance,” reads the order, a copy of which lies with the KNS.

The order reads, “Notice to non-applicants other than non-applicant no 1. Objections, if any, from non-applicant no 1 with the copy to counsel for applicant. Operation of order impugned dated 04-02-2015 shall stay and investigation, if any, being conducted shall be put on hold.”

The petition was submitted by the then Deputy Commissioner Srinagar  and others.
