In an act of revenge, the investigation into the alleged gang rape case of a mother of three children in Kuntwara area of Kishtwar District is heading towards a conspiracy hatched by the victim with her family members as among the five accused named by the victim, four accused namely Bashir Ahmed , Ghulam Hussain, Mohammed Rafiq and Parvaiz Ahmed are real brothers of a minor girl allegedly raped by the husband of the victim along with his three other accomplice at gun point on 25th of July 2013.
As per the details available with Kashmir Life, Khem Raj son Nek Ram resident of Hadar Kuntwara is wanted in rape case registered wide FIR No: 126/2013 registered U/S 376/367/109/342 RPC at police Station Kishtwar along with three other accuse namely Ranjeet Kumar son of Mangat Ram, Sanjeet Kumar son of Duni Chand, and Chadu Ram son of Manghat Ram of same village. While Sanjeet Kumar and Ranjeet Kumar were lodged in District jail Kishtwar, the other two accuse Chadu Ram and the husband of the victim Khem Raj is still absconding.
The authenticity of the case also fails to stand in the court of the law as among the five accused, four accused are not present in any part of the village. As per the sources one accused is in Ladakh, the other one was at Srinagar, 3rd one was at Kishtwar since last two weeks and the fourth accused is also not present in the village at the time of the incident.
The sources said that police has also verified the claims of the accused and found them genuine. The sources said that police is likely to file the investigation report in the court within next few days and the two accused present in Srinagar and Ladakh has reportedly offered to surrender and cooperation with investigation.
One accused namely Farooq Ahmed son Bashir Ahmed has already surrender before the Kishtwar police within minutes of surfacing his name in the case. Farooq was stationed at Kishtwar since last two week and the site of the incident is about 4-6 hour foot journey from nearest road side. The sources added that in addition to Kishtwar police, several intelligence agencies are conducting inquiry into this case as the rape case of the minor girl involving the husband of the victim has sparked massive protest in Kishtwar as among the accused involve in rape case of the minor girl, few has affiliation with Village Defense Committees. During the course of the investigation, a name of an advocate also surfaced who had guided them in creating fabricated crime scene. The agencies also did not rule out the hand of husband of the victim behind creating the drama of the rape after he fail to motivate the family of the minor girl for compromise. The sources said that police is probing all the angels and in next few days will be in a position to unravel the real motive. The police sources said that they are bound to register an FIR in cases like rape and added that weather the complaint is genuine or not, is the matter of investigation. Senior police officers also quiz the victim.
When contacted a senior police officer on the condition of anonymity confirm that the case has some loop holes and added that in case the accused are innocent, they will be released in accordance to law. He refuse to divulge any further detail with regard to progress in investigation.
It is pertinent to mention that Kishtwar police following the guidelines of the Apex court registered an FIR No: 233/13 U/S 376/34 RPC against five persons including four real brothers on the bases of complaint of 38 year old mother of three children in which she claims that she was alleged gang raped by five persons inside Kuntwara forest when she went inside the forest for collecting dry wood.
