Marwah Police of Kishtwar District Tuesday produced the challan in a 14 year-old rape and abduction case against nine accused before the Munsif Court Kishtwar.

As per the details available with Kashmir Life, the case was registered by the Marwah police on August 18, 2002 under FIR.No 30/2002 U/S 3rape-victim66/376/343/109 RPC on the basis of the complaint filed by the father of the rape victim which stated that they belong to nomadic family and during summer they shifted to Marwah Tehsil of Kishtwar district in search of food for cattle along with several others. On the day of the incident, accused Mohammad Iqbal Bakerwal son of Jumma Bakerwal Resident of Hiranagar Kathua enter into his shanty (Dhok) and committed rape of his daughter after finding her alone at home. He said that after filling complaint against the accused person, the accused along with his eight other associate forcefully barged inside his shanty and took away his daughter.

After registration of an FIR Marwah police started its investigation and arrested the accused and others and produce them in the court.

The court later bailed the main accused and others. After getting bail from the court, the accused suddenly disappeared and became untraceable.

The police led by top officers of the district made efforts and finally managed to trace out the six accused Tuesday successfully produced the challan against six persons while three other persons were declared as absconding by the court U/S 512 Cr.PC.

The six accused against whom challan were produce including Mohammad Iqbal son of Jumma Bakerwal Resident of Hiranagar Kathua, Asgar Ali son of Abdul Rashid Pajwala Resident of Jatwal Samba, Mohammad Shabir son of Mohammad Latief Bakerwal Resident of Vijaypur, Sardar son of Bashir Ahmed Bakerwal Resident of Parmadal Bishna, Mohammad Ashraf son of Abdul Rashid Bakerwal Resident of Reasi and Abdul Latief Son of Noorani Bakerwal Resident of Vijaypur Resident of Samba while three accused namely Ghulam Jan Son of Gugra Gujjar, Mohammad Ashraf alias Kalla Son of Lala alias Gorra Khan all Resident of Brarie Wagan Islamabad at present Kathua were declared absconders under section 512 Cr.PC.

When contacted Dy. SP Irshad Ahmed Ahanger said that the accused and the complainant negotiated the matter at its own level after getting bail from the Kishtwar Court added that later in order to escape the punishment, the accused married with the complainant and disappeared. He said that even though the complainant were produced by the police in the court in the year 2002 itself and recorded her statement U/S 164 Cr.PC , but she out of her own will had married with the accused and forget to bring the matter into the notice of the court or police.

He said that law takes its own course and it is up to the court to decide the case on the merits of investigation conducted by the police.
