President of India Pranab Mukerji has elevated Justice Mansoor Ahmed Mir of J&K High Court and has directed him to assume the charge of Chief Justice of Himachal Pradesh High Court.
Governor Himachal Pradesh Urmila Singh will administer oath to Chief Justice Mansoor Ahmed Mir at Raj Bhavan on Nov 27 this month.
Chief Justice Mansoor Ahmed Mir was born on April 25, 1955 at Rajpora village of South Kashmir’s Pulwama. His father Haji Muhammad Abdullah Mir send him to Primary School located in the same village and later on, he joined Amar Singh College in 1975 and completed his Bachelors Degree (BA) in 1976. He did his LLB in 1978 and joined bar in the same year and practiced till 1993.
Chief Justice Mansoor Ahmed Mir appeared in Higher Judicial services examination in the year 1992 and he secured Ist Position in the state. He was appointed as Principal District & Sessions Judge, Kupwara on May 27, 1993. He was posted as Principal District & Sessions Judge, Anantnag in (1995-1998). And, Presiding Officer, Motor Accident Claims Tribunal, Srinagar from 1998-2000. He was placed in the selection grade in the year 1998. He was then posted as Principal District and Session Judge, Budgam from 2000-2002. He was placed in super time scale in the year 2002 and posted as Presiding Officer, designated court of TADA/Special Judge, POTA for Kashmir division in 2002-2004.
Justice Mir was posted as Additional District and Sessions Judge, Srinagar in 2004 and Principal District and Session Judge, Srinagar from 2004 till elevated as additional Judge of the High Court of J&K. He was sworn in as additional Judge of the High Court on January 31, 2005 and appointed as permanent Judge of the High Court of Jammu and Kashmir on July 7, 2007.
He has the distinction of being the first Judicial Officer to be Posted as Presiding Officer, Designated Court of TADA/ Special Judge, POTA for Kashmir Division in 2002 and remained posted as such for two years till 2004.
Mir is known for his honesty and integrity. Supreme Court of India always see eye to eye with the decisions and verdicts passed by him.
The Supreme Court upheld his view that the right of occupancy in any land of an evacuee shall not be extinguished.
A bench led by Chief justice of India Alatamas Kabir and two companion Justices, Surinder Singh Nijjar and Chelameswar held, “The decision holding the settlement to be contrary to the provisions of Rule 13-C of the 2008 Rules, as held by Hakeem Imtiyaz Hussain on September 15, 2007, and affirmed by the third learned Judge, Y P Nargotra, by his judgment and order dated March 25, 2008, were not sustained and is set aside. Consequently, the view expressed by Justice Mansoor Ahmad Mir, is upheld.
Supreme Court of India also upheld his historic verdict on Cheque Bouncing matter. He also abrogated the death sentence of a Kashmiri citizen by Session Court Rajouri and set him free. Chief Justice Mansoor Ahmed Mir also reversed the verdict of Sessions Court Poonch and released several accused from Puchgoz Pulwama.
During the turmoil when thousands of files pertaining to different cases were catching dust, Mir single handedly after taking pains settle down most of these cases.
In a landmark decision, Chief Justice Mansoor Ahmed Mir in one of his verdicts directed Insurance companies to pay Rs one crore to affected families and the decision was implemented within days.
As Justice High Court Jammu and Kashmir, Mansoor Ahmed Mir disposed off at least 36,000 cases and awarded verdicts amoung which 2978 applications were looked by double bench.
Pertinently, from past 18 years only 13 judges from Jammu and Kashmir have been elevated to the post of Chief Justice.
