Jama’at-i-Islami Monday said that without taking into account the order of high court that had quashed the detention of Sheikh Muhammad Yousuf, 80 year old activist and local leader of Jama’at-e-Islami from Sopore, Police has been detained him for the second time under the “draconian” Public Safety Act.

A statement of Jama’at issued here read, “Instead of the fact that the high court had quashed the earlier detention order after finding the grounds to be illegal and unwarranted and taking into consideration his old age and infirm health conditions but the police ignoring all these facts, rearrested him soon after he was released from district jail Kupwara and kept him under custody in police station Sopore.”

After the concerned court granted bail to Yousuf, the statement said, police recommended his detention under PSA which has been readily accepted by the District Magistrate Baramulla without “applying his judicial mind” and has ordered Yousuf to be lodged in Kupwara jail again.

“Similarly, chairperson of Dukhtaran-e-Millat Asiya Andrabi has been rearrested by the police soon after she was released from district jail Baramulla on the directions of the high court which has quashed her detention order. Now she stands detained in Baramulla jail again. By these actions the police have been depicting their negative and contemptuous attitude towards the judiciary time and again. The court orders are no more than the pieces of waste papers before the police and the valley has virtually been turned into a police station.”

While denouncing the “misuse” of the Public Safety Act and other such black laws by the police, a spokesperson of Jama’at demanded early release of all political prisoners and detenues.

He also impressed upon the Kashmir Bar Association and other human rights organizations to take notice of “anti-people and dictatorial ways of police and state administration” and their contemptuous attitude towards the judiciary and make positive efforts to get it all stopped.
