The Jammu Wing of High Court  Friday while adjudicating upon a CMP filed in a petition bearing SWP No. 1283 of 2013 filed by Dr. Indu Koul, Professor, Government Medical College Jammu against the State and others, had on last date of hearing viz 29-08-2013 directed the Secretary J&K Public Service Commission (PSC) to produce records pertaining to promotion of private respondent Dr. Shashi Gupta, at present holding the charge of Principal, before it on September 6..

In compliance of the direction of the Court the Secretary PSC appeared before it along with the requisite records. The records produced by the Secretary have been taken on record by the High Court and the matter has been ordered to be listed for consideration on September 16.

On last date of hearing the Court had, after considering the objections filed by the State admitted the petition for hearing.  The case of the petitioner has been that the PSC held the petitioner eligible for promotion as Assistant Professor with effect from 26-01-1995, for having completed pre-requisite teaching experience of three years and in comparison the private respondent Dr. Shashi Gupta was held to be eligible for such promotion with effect from 23-04-1995 as she had unauthorisedly taken foreign assignment for about five years.

However, while affecting promotions, the Government with ‘ulterior motive’ of conferring undue benefit upon the private respondent promoted her with effect from 23-04-1994 which was done in ‘blatant violation’ of the recommendations of the PSC. In the meantime another Professor of GMC Jammu, aggrieved of the alleged ‘fraudulent’ promotions of the respondent doctor has also filed CMP seeking impleadment as party to the proceedings.
