The State Vigilance Organization presented a challan against Ab Hamid Reshi S/o Gh Hassan Reshi R/o Ameer Abad Tral, Pulwama the then Patwari Halqa Noorpora, Awantipora and Farukh Jahanzeb S/o Gh Mohi-u-din Bhat R/o Awantipora (private person) in the Court of Special Judge Anti Corruption Srinagar in case FIR No 20/2011 P/S VOK on Wednesday.
According to a VOK press release, during investigation of case FIR No 37/2010 u/s 5(1) C, 5(1) (d) r/w 5 (2) P.C. Act 2006 and section 120-B, 409, 468, 471 RPC registered in P/S VOK pertaining to misappropriation of compensation amount of over twenty crores meant for disbursement among the eligible beneficiaries (land owners) of four laning of National Highway in village Lethpora and adjacent villages of district Pulwama.
“Investigations revealed that Patwari Halqa Noorpora Tehsil Awantipora, Ab Hamid Reshi hatched criminal conspiracy in active collusion with accused (private person) namely Farukh Jahanzeb of case no 37/2010 P/S VOK has shown dishonestly and fraudulently land measuring 3 Kanals and 18 Marlas under survey No 303 min, and land measuring 3 Kanals and 2 Marlas under survey No 3643/2168 (14 Marlas 1 ? Sirsai), 3586/2169 (02 Kanals and 07 Marlas & 7 ? Sirsai) of patwar halqa Noorpora Tehsil Awantipora transferred through oral gift to said private person namely Farukh Jehanzeb.”
According to the statement, the perusal of revenue records revealed that the public servant with dishonest intension while abusing his official position has transferred the land by way of oral gift after manipulating the revenue records. “The accused official affixed fraud and fake signatures of attesting authorities viz the then Tehsildar Awantipora Sh Mushtaq Ahmad Bajard and the then Tehsildar settlement Awantipora Sh Ab Aziz Dar and consequently effected predate mutations in order to bestow favour upon the said private person in furtherance of criminal conspiracy by fraudulent, deceitful & illegal means”.
The act of the said accused public servant in league with the said private person (beneficiary) amounts to criminal misconduct which is punishable u/s 5 (2) P.C. Act smt 2006 r/w 120-B, 468, 466, 471 RPC on the basis of these findings the instant case came to be registered in P/S VOK and investigation taken up, the statement said.
On the basis of investigation conducted it has been established that the accused patwari halqa Noorpora in active conspiracy with accused private person Farukh Jehanzeb have prima facie committed offences punishable u/s 5(1) c , 5 (2) J&K P.C Act smt 2006 r/w 466, 468, 471 & 120-B RPC, it added.
