Police on Friday lodged an FIR against Independent Legislator representing Langate constituency, Er Rasheed for “instigating violence” in Pulwama on Thursday.

The FIR has been invoked under section 341 and 506 of RPC for “criminal intimidation”. Section 341 of RPC states, “whoever wrongfully restrains any person shall be punished with simple imprisonment for a term, which may extend to one month, or with fine which may extend to five hundred rupees, or with both.”

When contacted, cops at Police Station Pulwama confirmed that an FIR has been lodged against Rasheed, however, they did not divulge the details.

While 506 states, “whoever commits the offence of criminal intimidation shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both; if threat be to cause death or grievous hurt, etc. And if the threat be to cause death or grievous hurt, or to cause the destruction of any property by fire, or to cause an offence punishable with death or 1[imprisonment for life], or with imprisonment for a term which may extend to seven years, or to impute, un-chastity to a woman, shall be punished with imprisonment of either description for a term which may extend to seven years, or with fine, or with both.”

Rasheed was in Pulwama on Thursday to protest against the killing of a civilian by forces.

Speaking to Kashmir Life, Rasheed said, “Jammu and Kashmir has been virtually turned into a police state and even a legislator is being harassed at the behest of cheap tactics.”
