Underling that its directions on occupation of land and residential houses by Indian Army in Buthoo hamlet of North Kashmir’s Bandipora district were observed in breach, the Jammu and Kashmir High Court while reacting on a contempt petition has asked Financial Commissioner Home, Director Estates and District Magistrate Bandipora to file a reply within two weeks’ time and explain why court orders were not implemented in letter and spirit.
Petitioner Ghulam Nabi Reshi of Buthoo Bandipora had filed a petition through his counsel Advocate Bashir Ahmed Tak that Army in 2006 occupied their four residential houses and orchard land comprising of 23 kanals and 7 marlas.
In 2015, the High Court had directed Financial Commissioner Home and District Magistrate Bandipora to relocate Army to some other place; however, even after the expiry of one year, the court order was not implemented on ground.
Advocate Bashir Ahmed Tak file contempt petition vide number 278/2016 drawing the attention of the court towards the matter.
Justice Muzaffar Hussain Attar, according to CNS, maintained that court orders have been violated and he directed Financial Commissioner Home R K Goyal, Director Estates Kashmir K Goyal and District Magistrate Bandipora Sajad Ahmed Ganaie to explain their position within two weeks’ time.
The court directed the authorities to relocate the Army and vacate the land and residential house from their occupation. The court further directed the authorities to pay the rent to the owners of the land and residential houses under revised scale.
