Jammu Kashmir Revises Ex-Gratia Relief Guidelines for Security, Civil Disturbance Victims

   

SRINAGAR: The Jammu and Kashmir administration has issued a comprehensive set of instructions for granting ex gratia relief to individuals affected by law and order disturbances, covering government employees, security personnel, civilians, and defence forces. The move, notified through a government order aims to streamline compensation under the Security Related Expenditure (SRE) framework.

The policy specifies compensation slabs for deaths, permanent disabilities, partial disabilities and multiple categories of injuries.

Under the category of magistrates and police personnel, the order sets ex gratia at Rs 2 lakh for the death of a magistrate and Rs 5 lakh for police personnel and special police officers. Families of ex servicemen are entitled to Rs 2 lakh. Permanent disability cases receive Rs 75,000, while partial disability attracts Rs 10,000.

For Central Armed Police Forces, non-domiciled personnel who die during disturbances will receive Rs 5 lakh, whereas domiciled CAPF personnel, irrespective of whether death occurs within or outside the Union Territory, are eligible for Rs 25 lakh. Permanent disability compensation remains fixed at Rs 75,000, and partial disability at Rs 10,000.

The order prescribes Rs 1 lakh as ex gratia for the death of civil government employees and Rs 75,000 for permanent disability. Injury-related compensation has been notified as Rs 5,000 for hospitalisation beyond twenty-four hours, Rs 1,000 for treatment under twenty-four hours, and Rs 500 for minor injuries requiring only first aid.

For civilians, surrendered militants and militants turned informers, ex gratia for death has also been fixed at Rs 1 lakh, including cases along the International Border or Line of Control. Permanent disability will draw Rs 75,000, while injuries fall under the three-tier compensation structure of Rs 5,000, Rs 1,000 and Rs 500.

Under the defence personnel category, domiciles of Jammu and Kashmir will receive Rs 5 lakh in case of death, while those who die within the Union Territory are entitled to Rs 25 lakh.

The policy also outlines compensation for property damage caused by sabotage, explosions or similar incidents. Relief has been set at fifty per cent of the assessed loss or Rs 1 lakh, whichever is lower. For extensive losses, the ceiling has been fixed at Rs 10 lakh, including Rs 7 lakh for immovable and Rs 3 lakh for movable property. Damage resulting from cross-border shelling along the International Border or Line of Control is capped at fifty per cent of the assessed loss or Rs 1 lakh.
