In an open letter, the Awami National Conference Chairperson, Begum Khalida Shah today asked Chief Minister Omar Abdullah to initiate action against construction of an illegal structure by Omar Khalil Nedous.

In the letter addressed to Chief Minister, Khalida writes, “The illegal structure having been raised by one, Omar Khalil Nedous in violation of all the existing laws including the Municipal Law has been received with a great shock and surprise to me. The above said offender was asked to stop with the illegal un-called for Construction forthwith but he brushed aside the same with complete contempt against all the norms of decency fair play and Justice. Thereafter the Concerned Municipal authorities were approached, who sought a vigilance report and the same was duly examined and explicitly confirmed the violation on 31st may 2013.”

“This may be pertinent to mention here in the first instance that I am constrained to bring to your notice about the gross violation of the laws of the land by one, Omar Khalil Nedous which was duly examined verified and confirmed by the vigilance team of the Municipal Authorities. Despite this all they have not done the needful as was required under law and it is because of this dereliction of their duties and abuse of their authority that I am entering into this communication to you as the Constitutional and legal Custodian of all the rights of the citizens of this unfortunate state,” the letter further reads.

She has also castigated the Municipal Authorities for alleged inaction against the illegal structure. “In spite all the efforts having been put in by me, have not yielded any results on ground but a strange, uncalled for, an astonishing explanation has been offered by the Municipal authorities that their entry into the compound was blocked by the said offender by taking law into his own hands. I fail to understand as to why legal proceedings were not initiated against the offender for causing obstruction in the discharge of the official duties of all such officers who were supposed to discharge their official duties by way of effecting the demolition of the illegal Construction,” she writes.

“Needless to say that the area in which the illegal construction is under operation falls within the prohibited area where no construction or any structural changes can be made in the absence of Valid legal sanction and authority particularly when it violates the laws of the Land. I, believe that you being the CM of the state of J&K would raise from all the prejudices and order for the removal of the above said illegal structure in accordance with the principles of administration of fair-play and Justice, at the earliest,” she adds.

A copy of the letter has also been sent to Governor N N Vohra, Dr Farooq Abdullah, Minister for Urban Development, Nawang Rigzin Jora and Commissioner SMC, Dr G N Qasba.
