The Jammu and Kashmir High Court has directed the trial court not to pass any order into the killing of a Kashmiri trucker in a petrol bomb attack in Udhampur last year.
Zahid Rasool Bhat, one of the truckers, injured in Udhampur attack in October 2015 had succumbed at New Delhi’s Safdarjung hospital. Bhat had suffered 70 per cent injuries after a mob set on fire a truck in which he was sleeping along with two more Kashmiris in Udhampur area of Jammu on October 9 last year.
Justice Muhammad Yaqoob Mir of Jammu Kashmir High Court passed these directions in response to a transfer application filed by Ghulam Nabi, brother of deceased trucker Zahid Rasool Bhat.The HC also sought objections from the government within one week.
In the transfer application, Ghulam Nabi submitted that the Public Prosecutor of the concerned court belonged to a particular group and was also being influenced accordingly by those having particular ideology which is different to the community to which the petitioner belongs. He also submitted that he has no faith in the Bar Association of Udhampur, for they are being influenced by particular group of people.
Justice Mohammad Yaqoob Mir of J&K High Court, after hearing advocate Joyti Sharma for the petitioner and AAG WS Nagral for the State, directed the later to file objections within one week. The High Court also directed that trial court shall not pass any order till next date of hearing before the Bench. (CNS)
