NEW DELHI: A Delhi court is likely to decide today whether a case of alleged terror funding against Jammu and Kashmir Lok Sabha member Engineer Rashid will be transferred to the designated MP/MLA court, now that he is a lawmaker.
Additional Sessions Judge Chander Jit Singh also scheduled for tomorrow the order on Rashid’s regular bail application.
The judge had earlier observed that the case could be transferred to a special court meant for lawmakers.
Rashid, elected from the Baramulla Lok Sabha constituency in the recent elections, has been in Tihar jail since 2019 after being arrested by the NIA under the Unlawful Activities (Prevention) Act (UAPA) in a 2017 terror funding case.
The judge had reserved the bail order, stating that the issue of jurisdiction and whether to transfer the case to a special court would be considered first.
Rashid had surrendered before the Tihar jail authorities on 28 October, after the completion of his interim bail period.
On 10 September, the court granted interim bail to Sheikh Abdul Rashid, commonly known as Engineer Rashid, to enable him to campaign for the Jammu and Kashmir assembly elections and deferred the order on his regular bail plea.
The interim bail was later extended until 28 October, citing his father’s poor health, after the NIA verified documents and did not oppose the plea.
Elections to the 90-member Jammu and Kashmir Assembly were conducted in three phases between 18 September and 1 October. The National Conference-Congress alliance won with 48 seats.
