Jammu Kashmir High Court Upholds PSA Detention of Alleged LeT, TRF Associate; Police Book Five More

   

SRINAGAR: The High Court of Jammu & Kashmir and Ladakh has upheld the preventive detention of Tahir Riyaz Dar under the Public Safety Act (PSA), citing his alleged involvement in providing logistical support to banned militant outfits Lashkar-e-Toiba (LeT) and The Resistance Front (TRF), and in instigating youth in the area towards subversive activities.

While dismissing the petition challenging his detention, Justice Rajesh Sekhri observed that the preventive detention order was based on a “reasonable prognosis” of Dar’s future conduct, derived from his past activities and prevailing circumstances.

“This court, in exercise of writ jurisdiction under Article 226 of the Constitution of India, has a limited scope to scrutinise the grounds of detention and cannot examine the sufficiency of material,” Justice Sekhri said. He noted that the detention order was backed by precise and proximate grounds, conveyed to the detainee in a language he understands.

The court also observed that the detaining authority had recorded its “subjective satisfaction” based on detailed facts and figures that justified invoking Section 8 of the PSA to prevent Dar from continuing what were described as prejudicial activities.

Meanwhile, in a separate development, police in Srinagar have detained five individuals under the PSA for their alleged involvement in aiding militancy and engaging in activities described by authorities as subversive.

According to a police spokesperson, those detained include Nayeem Ahmad Khan of Gamandar Panthachowk, Faizan Akhter Bhat alias Faizan of Gousia Colony Khanyar, Mehraj Ud Din Bhat of Pandach, Umar Hamid Sheikh of Assar Colony Hazratbal, and Suhaib Shafi Baba alias Chamna of Diwat Walipora Rainawari.

“These individuals have been booked under PSA after formal detention orders were obtained based on detailed dossiers prepared by Srinagar Police,” the statement said. The accused have been lodged in district jails at Kathua, Udhampur, and Kot Balwal in Jammu.

Police noted that several criminal cases had previously been registered against the detainees, and despite being granted bail by courts, they allegedly resumed activities deemed prejudicial to public order and national security.

“Police have been systematically targeting and dismantling such anti-national infrastructure in Srinagar city through a relentless crackdown,” the statement added, affirming the force’s commitment to upholding peace and security in the region.
