SRINAGAR: A court in Tangmarg has convicted and sentenced a man for rash and negligent driving resulting in the death of a person eleven years ago in Baramulla district, North Kashmir.
According to the prosecution, on July 7, 2012, the Tangmarg police station received information that a person named Bilal Ahmad Magrey had been critically injured by a stone near the stone crusher Shrai Nallah in Tangmarg. Magrey was taken to Tangmarg Hospital where he later passed away, as confirmed by the police.
However, upon further investigation, it was revealed that Magrey did not die due to a stone but rather from being hit by a Tipper (JK05-6067) driven by the accused at the time of the incident, stated the prosecution.
On July 14, 2012, a formal FIR (No. 90/2012) was registered under sections 279 and 304-A RPC at the Tangmarg police station. The chargesheet was filed on December 19, 2012, and the accused, Riyaz Ahmad Dar, son of Abdul Khaliq Dar, was eventually convicted and sentenced by the court of Judicial Magistrate 1st Class Tangmarg, Towseef Ahmad Mir.
“After considering the arguments presented by Sr Prosecuting Officer Salim Javid for the police and the counsel for the accused, the court concluded that the prosecution has fully established beyond any shadow of doubt that the accused caused the death of Bilal Ahmad Magrey through rash and negligent driving of the Tipper bearing Registration No. JK05-6067,” stated the court as per the judgment with GNS.
The court convicted Riyaz Ahmad Dar under sections 279 and 304-A RPC, stating that all the elements of the aforementioned sections were fully established.
Consequently, the court sentenced Dar to one year of simple imprisonment for the offence under section 304-A RPC and ordered him to pay a compensation amount of Rs. 50,000 to the legal heir of the deceased. Additionally, the court sentenced him to two months of simple imprisonment for the offence under section 279 RPC.
“All the sentences shall run concurrently. If the fine and compensation amount are not paid, he shall further undergo simple imprisonment for a period of two months,” added the court. (GNS)
