Sale, Possession of Scheduled Birds to Result in Jail Term, Heavy Fines

   

SRINAGAR: The Wildlife Department Kashmir has warned sternly against the sale, purchase, and possession of Scheduled birds, declaring such activities a criminal offence under the Wild Life (Protection) Act, 1972.

According to an official communication from the Wildlife Warden, Wetlands Division Kashmir, Srinagar, any individual or bird vendor found engaging in these prohibited activities will face legal action. The Department reminded the public that under Section 51 of the Act, offenders are liable to imprisonment for up to seven years, a fine of up to Rs 1 lakh, or both.

Specifically, if the offence involves a bird listed under Schedule I of the Act, the punishment shall be not less than three years and may extend to seven years, along with a minimum fine of Rs 25,000. For offences involving birds listed under Schedule II, the penalty includes imprisonment for up to three years and a fine of at least Rs 25,000.

Authorities noted that it has come to their attention that some birds protected under Schedules I and II are being illegally traded by vendors or kept by individuals as pets, an act strictly forbidden under the law.

The Department has urged individuals currently in possession of any Scheduled bird to voluntarily surrender them at the nearest wildlife facility to avoid prosecution. Officials assured that all surrendered birds would be properly rehabilitated and cared for.
