While taking strong note of non-compliance, Jammu and Kashmir High Court has given a deadline of February 10 to Divisional Commissioner Kashmir to submit compliance report regarding private coaching centers.

The Division Bench of the HC comprising Justice Muzaffar Hussain Attar and Justice Raj Kotwal Tuesday took strong note of non-compliance of its December 30, 2014 order by the authorities and asked the Divisional Commissioner and other concerned authorities to submit the compliance order by February 10.

“Compliance report has not been filed by the Divisional Commissioner and other concerned authorities in terms of the Court Order dated 30 December 2014. Mr R A Khan, learned Advocate General, submitted that compliance order will be filed during the course of week. The issue involved in this petition is of significant public importance,” the DB in its latest order observed.

“The Court on Dec 30 had issued a slew of directions. The issuance of directions had become necessary for the welfare of the student community. More than one month has passed, nothing is brought to the notice of the Court as to how and in which manner the directions, contained in the order have been implemented. We are constrained to place on record our anguish about the conduct of the authorities. However, before proceeding against the authorities, we give them last opportunity,” the DB said.

The DB also ordered that in case the authorities fail to submit the report within the stipulated time, Divisional Commissioner Kashmir and other concerned authorities appear in person before the Court on next date.

In its 30 December 2014 order, the DB had directed all the coaching centers functioning in Kashmir division to file undertaking before the Registrar Judicial within seven days, indicating therein that they will comply with the mandate contained in J&K Regulation of Private Tuition Centres Rules of 2010.

Except a few coaching centers most have failed to comply with the Court directions. “Mr Nasir Qadri appearing on behalf of Coaching Centers Association submitted that within three days time the required undertaking will be filed. We allow the prayer. In case the Court order isn’t complied within three days, the Divisional Commissioner Kashmir shall close down all the coaching centers,” the DB ordered.
