SRINAGAR: In a significant development, the High Court has granted permission to the government to construct temporary structures in and around the popular tourist resort of Sonamarg. The purpose of these structures is to facilitate and provide convenience to the pilgrims undertaking the Amarnath Yatra. However, the court has made it clear that these structures must be demolished upon the completion of the pilgrimage.

The Division Bench comprising Chief Justice N Kotiswar Singh and Justice Moksha Kazmi acknowledged the potential implications of construction and renovation on the environment and ecology of Sonamarg. Nevertheless, the court recognised the need to accommodate the large number of pilgrims expected during the upcoming Amarnath Yatra and allowed the erection of only temporary structures for this purpose.

The court emphasized that the issue at hand pertains to crucial environmental concerns regarding the preservation of Sonamarg. Before considering the ban order issued by the court on March 27 of this year, the court decided to permit the construction of temporary structures to ensure the provision of convenient facilities for the yatris and pilgrims.

It was further clarified by the court that once the Amarnath Yatra concludes, these structures must be demolished in accordance with the previous regulations. “Accordingly, the aforesaid order dated 27.3.2023 passed by this court is modified only for the aforesaid period till the conclusion of Amarnath Yatra of this year,” stated the court order.

It is worth noting that the court had previously expressed concern over the ongoing construction activities taking place in and around the renowned tourist destination of Sonamarg. In response, the court had directed that all constructional activities in the area adhere strictly to the Master Plan and that no construction should take place without obtaining building permission from the Sonamarg Development Authority (SDA).

In addition, the court has instructed the Forest Department and Wildlife Department to provide an updated response to the Public Interest Litigation (PIL) filed, considering their vital role as stakeholders in preserving the environment of Sonamarg.

The decision of the High Court to allow temporary structures for the Amarnath Yatra demonstrates the delicate balance between providing facilities for pilgrims and ensuring the protection of the environment in one of the region’s most scenic tourist spots.
