Noted Human Rights defender Khurram Parvez was arrested on the intervening night of 14 and 15 September. He was lodged in Kothi Bagh police station, shifted to Kupwara Jail; released and after being re-arrested, he was lodged in Kupwara police station before being shifted to Kothi Bagh Police Station.

On September 21 night, he was driven to Kotbalwal Jail Jammu, some 300 KM away from his home, and detained under Public Safety Act (PSA). The PSA has been declared a ‘lawless law’ by human rights watch dog Amnesty International.

Khurram is Coordinator of Jammu and Kashmir Coalition of Civil Society (CCS) and chairperson of Asian Federation Against Involuntary Disappearances (AFAD). Ahead of his arrest, Khurram was stopped from flying to Geneva on September 14, 2016 where he was scheduled to attend 33rd session of UNHRC. On Sep 23, 2016, New York Times in its editorial while advising against war in South Asia, sought release of Khurram Parvez and lifting of ban on his travel.

In a statement, CCS made public the dossier made by J&K Police against Khurram which was submitted before district magistrate Srinagar who finally ordered his detention.

Under PSA, a detainee can be held without trial for at least six months and the detention extends up to two years.

The subject is an anti-social element known for his anti-national activities which are prejudicial to the maintenance of public order. The subject has been found instrumental in mobilizing the anti-social elements in the on-going unrest for carrying on secessionist activities. The subject has achieved a prominent position in the separatist camps under a hidden cover of being a human rights activist. The subject in the on-going unrest has been found instigating and advocating the disgruntled elements to resort to illegal activities and rise against the union of India.

The subject is a resident of Gupkar, Srinagar and is aged about 36 years. The subject received his early education from Burn Hall and Biscoe School and graduated from Government Degree College Bemina Srinagar. The subject completed his Masters Degree in Journalism in the year 2004 through Kashmir University Srinagar. After his studies, the subject joined a human rights organization namely Human Resources and became its self-styled chairman in April 2004 and in the year 2005 got himself associated with newly floated Human Rights organization namely J&K Collation of Civil Society (JKCCS) and started working with it as a Coordinator which he continues till date.

The subject has a long history of affiliation with secessionist organizations who advocate secession of state of J&K from the union of India and to achieve this goal the subject has been found resorting to illegal/unlawful activities since long, be it utilizing the youth to resort to violence or gathering so-called Human Rights activists and glorifying the death of terrorist and has been asking the general public to adopt the path of secessionist activities.

The subject having secessionist ideology and inclination towards secessionism, during the present unrest has remained instrumental in instigating the disgruntled elements to resort to violence by indulging in stone pelting upon security personals which in turn disrupts the public order. The subject wields a considerable clout in the secessionist circles devised strategy wherein programmes are formulated in such a manner to keep the present law and order problem boiling besides instigating the disgruntled elements to resort to large scale violence so as to keep the pot boiling. The subject has been found supporting the programmes/calendars of the secessionist elements on ground by giving sermons to the disgruntled elements to resort to unlawful activities which have resulted in casualties and destruction of public property and create an atmosphere of chaos, anarchy in the valley. The activities of the subject are a direct threat to the maintenance of public order, if not stopped by invoking the provisions of Public Safety Act.

The subject has been found involved as an accused in below mentioned cases wherein his role as an instigator has surfaced and it was found that it was on his instigation that disgruntled elements resorted to large scale violence whereby besides causing damage to the public property, activities of life in society come to a standstill. Looking at the situation from a broader perspective, it appears that under a well-knit conspiracy, the subject and his other associates are intentionally resorting to such activities which disturb the public peace and these elements challenge the sovereignty and integrity of the country by following aims and activities of secessionist nature. The activities of the subject and likeminded elements in fact contribute to the overall surcharged atmosphere, created by secessionist elements in the on-going unrest, who have been sponsoring strikes and anybody who dears to defy their dictations is being harassed/attacked by the elements like the subject leaving them with no option but to follow their illegal dictates.

The activities of the subject referred above are highly prejudicial to the maintenance of public order and warrants immediate preventive measures. The ordinary law has not been found adequate to deter him from indulging in repeated acts of this nature. Therefore law enforcing agencies have been left with no option but to invoke the provisions of PSA for the detention of the subject so that he is prevented from indulging in activities which are prejudicial to the peace and public order.

It is, as such, requested that a warrant of detention under the provisions of PSA may kindly be issued against the subject and sent to this office for its early execution.
