High Court Quashes Rape FIR, Cites Pattern of Similar Complaints by Woman

   

SRINAGAR: The Bombay High Court has quashed a rape FIR lodged by a woman, observing a recurring pattern of filing similar criminal complaints against different individuals and expressing concern over the alleged misuse of legal provisions.

The court noted that the complainant had previously registered multiple FIRs, including allegations of rape and other offences, against various persons. After examining the record, the High Court observed that several of these complaints were found to be unsupported, indicating a pattern that warranted judicial scrutiny.

While hearing the case, Justice Ranjitsinh Bhonsale observed that the complainant appeared to have repeatedly entered into consensual relationships and later initiated criminal proceedings against the individuals involved. The court held that allowing the present case to continue would amount to an abuse of the judicial process and, therefore, ordered the FIR to be quashed.

The High Court also underscored the importance of preventing the misuse of stringent criminal laws, stating that false allegations can cause serious harm to innocent individuals while simultaneously affecting the credibility of genuine victims seeking justice. The court stressed that every complaint must be examined on its own merits through a fair and objective process.

In its observations, the court reportedly advised the Maharashtra Police to exercise due diligence while dealing with any future complaints filed by the woman, taking into account her history of lodging multiple cases of a similar nature. The court emphasised the need for proper verification and careful assessment before initiating legal action on such allegations.

Legal experts have described the judgment as a significant reminder that while laws enacted for the protection of women must be implemented firmly and effectively, adequate safeguards are equally necessary to prevent their misuse and to protect innocent citizens from unwarranted prosecution.
