Jammu Kashmir Makes Police Clearance Mandatory for Retired Government Employees Seeking Private Jobs

   

SRINAGAR: Retired government employees in Jammu and Kashmir will now need a clean chit from the police before taking up post-retirement employment in the private sector.

The Jammu and Kashmir government has issued a directive to private organisations employing individuals who have superannuated after turning 60. According to a notice from the Information and Public Relations Department, the Criminal Investigation Department (CID) of the police has been tasked with verifying the character and antecedents of retired employees.

The notice states that it is the responsibility of the head of the private organisation to ensure that the CID clearance is obtained before employing any retired government official. Violations of this procedure could invite legal action against the employer.

Previously, such security clearance was mandatory only for appointments in the government sector. Over the past four years, a number of government employees were terminated by the Lieutenant Governor Manoj Sinha-led administration for allegedly posing a threat to the state’s security. These actions were taken under Article 311(2)(C) of the Constitution, which allows termination without inquiry if deemed necessary for state security.

Officials said the new regulation aims to ensure that only eligible and genuinely suitable retired employees are engaged in private roles, preventing those facing serious charges or security concerns from securing positions in private offices.
