Out of 1,263 Kashmir Migrant Registration Cases, 75 Await CID, DM Reports: Govt Tells House

   

SRINAGAR: The Government of Jammu and Kashmir on Tuesday informed the Legislative Assembly that Government Order No. 34-JK(DMRRR) of 2022 does not dilute the service interests of Prime Minister’s Package employees but instead provides a structured framework for cadre management, postings and promotions.

Replying to Assembly Question tabled by MLA Mohammad Yousuf Tarigami, Minister In-Charge, Disaster Management, Relief, Rehabilitation and Reconstruction Department, said the 2022 order supplements earlier recruitment and post-creation orders and ensures that PM Package employees are not placed at a disadvantage vis-à-vis regular employees.

The Minister said the recruitment of Kashmiri Migrants under the Prime Minister’s Package is governed by the JK Migrant (Special Drive) Recruitment Rules, 2009, notified vide SRO-412 dated December 30, 2009. He added that 6,000 supernumerary posts were sanctioned in phases—3,000 posts under Government Order No. Rev/MR/141 of 2009 dated October 6, 2009, and another 3,000 under Government Order No. 58-JK(DMRRR) of 2017 dated July 29, 2017.

The Minister said the 2022 order was issued to regulate seniority, cadre management and career progression in a structured manner following large-scale appointments under the package. The order provides for maintenance of a separate seniority list, creation of pre-facto supernumerary posts for promotions, treatment of PM Package posts as Divisional Cadre posts of Kashmir Division, and extension of in-situ promotion avenues.

“There is no inconsistency between Government Order No. Rev/MR/141 of 2009, Government Order No. 58-JK(DMRRR) of 2017 and Government Order No. 34-JK(DMRRR) of 2022. The latter only supplements the earlier orders by providing a comprehensive service regulation mechanism after appointment,” the Minister said.

On further improvements in service management and regular cadre structure, the House was informed that the matter has already been taken up with the General Administration Department and the Finance Department for examination under rules.

Responding to another part of the question regarding acquisition of migrant land in Kashmir for public assets such as schools, hospitals and roads, the Minister said District Magistrates have been designated as custodians under the Jammu and Kashmir Migrant Immovable Property (Preservation, Protection and Restraint on Distress Sales) Act, 1997. He said acquisitions, wherever made, are carried out as per prescribed procedures under applicable land acquisition laws and compensation is assessed accordingly.

On the issue of provisional registration of Kashmiri Migrants, the Minister said that in a meeting chaired by the Chief Secretary on July 12, 2023, it was decided that in view of improvement in the overall law and order situation in the Valley, fresh registrations on security grounds were not justified and no further extensions to provisional registrations would be granted.

He said that vide Government Order No. 1107-JK(GAD) of 2024 dated May 29, 2024, read with Government Order No. 1736-JK(GAD) of 2024 dated October 11, 2024, a Screening Committee headed by the Administrative Secretary, Home Department, was constituted to examine cases.

The Committee has been mandated to screen and approve registration of families provisionally registered with the Relief Organisation (M), JK, and to dispose of 1,250 applications for confirmed registration on a case-to-case basis after threat perception verification by the Criminal Investigation Department (CID) and the concerned District Magistrates.

The Minister informed the House that out of 1,263 cases examined, CID and District Magistrate reports are awaited in 75 cases, which will be decided immediately upon receipt of reports. He said there is no inordinate delay as the process involves security assessment and detailed verification.

The House was also informed that the Relief Organisation (Migrant) continues to provide free ration to registered migrants under Government Order No. 52/CR/REV/E of 1990 dated March 23, 1990. Integration of registered migrant families, including pensioners, into the National Food Security Act database has enabled eligible migrants to receive entitled food grains under the Public Distribution System.
