Owaisi Slams Bills Allowing Removal of Arrested PMs, CMs and Ministers

   

SRINAGAR: Hyderabad MP and AIMIM president Asaduddin Owaisi on Wednesday strongly opposed the introduction of three Bills in the Lok Sabha that seek to empower the removal of the Prime Minister, Chief Ministers, Union and State Ministers, as well as Ministers in Union Territories, if arrested or detained on serious criminal charges.

Owaisi as per The Hindu said, he had served notice to oppose the introduction of The Constitution (130th Amendment) Bill, 2025, The Jammu and Kashmir Reorganisation (Amendment) Bill, 2025, and The Government of Union Territories (Amendment) Bill, 2025.

Calling the proposed changes “draconian,” the AIMIM chief warned that they would hand sweeping powers to executive agencies, enabling them to act as “judge, jury and executioner.” He cautioned that under the amendments, ministers could be removed not only on arrest but even on detention for 30 days, making elected representatives vulnerable to arbitrary action.

“They want to turn the country into a police state. This is the quintessential 1933 moment which saw the formation of the Gestapo,” Mr. Owaisi said as per Hindustan Times report, describing the move as a “massive blow” to democracy and federalism.

He argued that under the Constitution, ministers can be removed either if the Prime Minister or Chief Minister recommends their dismissal, or if the Council of Ministers loses confidence. “These Bills bypass that principle and place elected leaders at the mercy of central agencies like the CBI and ED,” he said, adding that All India Services officers themselves report to the Centre through the Department of Personnel and Training.

Mr. Owaisi also cited recent cases involving leaders such as N. Chandrababu Naidu, Hemant Soren and Arvind Kejriwal, who faced prolonged incarceration, to argue that provisions of the Bharatiya Nyaya Sanhita and the Prevention of Money Laundering Act could be invoked arbitrarily for detention.

“I am opposing the very introduction of these Bills,” the Hyderabad MP asserted, warning that their passage would erode federalism and undermine the authority of elected governments.
